Increased transparency, increased liability: stricter requirements on product information in 2026

The German Unfair Competition Act (UWG) will be significantly stricter starting September 27, 2026 with a focus on public information e. g. in online shops. Environmental-related statements such as “sustainable” or “environmentally friendly,” “resource-efficient,” “CO₂-reduced,” or “climate-neutral” may no longer be made without appropriate evidence. If such statements are made, the amendment to the law imposes high transparency requirements to ensure that the statements can be verified.

Similar requirements will apply to information on durability, reparability, and software updates: statements such as “particularly durable” or “update required” must be accurate and verifiable. Companies may not conceal the negative effects of updates, nor may they highlight legally prescribed standards as a unique feature.

Companies are now required to carefully review their product information for compliance with the upcoming legal requirements in order to minimize the risks of competition law warnings and fines of up to 4% of EU annual turnover.
